Thank you for visiting Growheels Technologies Private Limited’s (hereinafter referred to as “Growheels”, “VQualify”, “we”, “us”, or “our”) Website available at vqualify.com (“Website”). We take your privacy very seriously, and this Privacy Notice (“Privacy Notice”) explains the ways in which we collect, use, disclose, and protect information relating to our Website and Services (hereinafter collectively referred to as “Platform”). By clicking on the consent check box, and by accessing and using the Platform, you accept the terms and conditions of this Privacy Notice. You hereby agree and provide consent to the Platform for processing personal data for the purposes and the scope defined in this Privacy Notice. If you do not agree to the terms of this Privacy Notice, you may withdraw your consent or choose not to provide your personal data on the Platform. Such an intimation to withdraw your consent can be provided by email on vqualify.com. We will cease processing your Personal Data within a reasonable timeframe unless we are required to retain it under applicable law.

This Privacy Notice may be amended at any time. The updated Privacy Notice will be made available through our Platform along with the date of the latest revision. If such modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change via email or through the Platform.

If you are accessing the Platform on behalf of a third party, you represent that you have the authority to bind such third party to the terms and conditions of this Privacy Notice and, in such an event, your use of the Platform shall refer to use by such third party. If you do not have such an authority (to provide personal data of a third party) or do not agree to the terms of this Privacy Notice, then you should refrain from using the Platform.

This Privacy Notice is an electronic record in the form of an electronic document and construed in accordance with the data protection laws of India.

Capitalised terms not defined in this Privacy Policy have the meaning assigned to them in our Terms of Service, “General Terms” section, found at growheels.com/terms-of-service.

Definitions:

  • “Personal Data” means any information/ data that relates to an identified or identifiable natural person;
  • “User(s)”, “you”, “your” shall mean a natural person who uses, registers, or accesses the Website.

Information We Collect Directly from You:

We collect different types of information from or through the Platform.

  • Account Information: When you sign up for an account on the Platform, you select a User ID (by entering an email address and password), and we collect and store that information. Collected information is data we have solicited in a form or obtained via cookies or by other means; stored information is collected information that has been subsequently deposited into our databases after collection. In addition to your User ID, we also collect and store your first name and last name. We may also collect and store your company name, telephone number, address, and certain other information about you that may be required by us to provide the Services or be disclosed by you during your use of the Services.
  • Billing Information: When your account includes a subscription, we do not collect your credit card number or banking information. When you enter your credit card number, it is sent directly to our third-party payment provider. From there, our third-party payment provider transfers billing information to the required intermediaries for payment processing. The payment processor’s use of your Personal Data will be governed by their Privacy Notice. We do not access, store, or collect your credit/debit card information. We may have information limited to the payment confirmation number for our record purposes.
  • You agree that our third-party payment providers and processors may collect and store your billing address and payment information on our behalf, and that we may change our payment provider and processor at any time for any reason.
  • Billing Address: Platform will collect and store your billing address. We adhere to all controls required for handling cardholder data in accordance with Payment Card Industry (PCI) compliance standards.
  • Log Data: When you use the Platform, our servers may automatically collect and store information, including information that your browser sends whenever you visit the Platform. This log data may include, but is not limited to, your Internet Protocol (IP) address, the address of the web page you visited before using the Services, the operating system you are using, the date and time of your accessing the Services, geolocation information, type of device, cookie data, and browser signatures.
  • IP Addresses: We will log the IP address of any visitor to a webpage you create and publish using the Services to calculate traffic usage per account and conversion rates per variant, investigate spam allegations and discrepancies in page statistics, as well as to ensure the security of the Website, Services, and related data. The Platform never uses the IP address or other Personal Data of visitors to your pages to conduct marketing activities or promote the Services.
  • Financial Profiling Data: In connection with loan facilitation and financial services, we may collect and process financial profiling information, including but not limited to: monthly or annual income, employment type and status, profession or occupation, financial eligibility indicators, loan amount preferences, repayment capacity information, and loan-related intent data. This information is used to assess eligibility for financial products, match you with appropriate loan partners, facilitate credit evaluation processes, and provide personalized financial product recommendations.
  • Cookies and Log Files: Cookies are small amounts of data that are transferred to your web browser by a web server and are used to collect and store information about a user. The ways we use cookies include, but are not limited to, tracking which webpage variant a visitor has seen, monitoring traffic patterns, and gauging the popularity of service options. Cookies also allow us to ensure that visitors see the webpage variant they expect to see if they return to the same website URL, and to calculate total visits and views per webpage, variant, account, and client sub-account. First-party cookies on The Platform landing pages are anonymous and cannot be used on their own to identify an individual.
  • Call Recording and AI-Based Analysis: When you interact with our call centre representatives, we record telephone conversations for quality assurance, training, compliance monitoring, and performance evaluation purposes. These call recordings may contain your voice, Personal Data, and financial information discussed during the call. We use artificial intelligence and machine learning systems, including third party API or any other-party AI service providers, to analyze raw audio recordings and generate structured performance reports. This automated analysis evaluates agent performance, call quality metrics, customer sentiment, and compliance adherence. Call recordings and associated data may be processed by third-party AI providers, which may involve cross-border data transfers subject to appropriate safeguards as described in this Privacy Notice. By engaging with our call center services, you consent to the recording, storage, and AI-based analysis of your calls as described herein. For ease of the reader of this Privacy Notice, we have provided an itemized description of the Personal Data received and the purposes for which it may be processed.
  • Lead Data: We collect contact information and other data you choose to provide via contact forms to allow us to solicit information from individuals and to send notifications via SMS, promotional messages, and calls. Additionally, in connection with promotions and incentives, we may collect vehicle photographs, selfie images, Registration Certificate (RC) copies, proof of purchase, social media handles, and other related information. This data is used to verify eligibility, prevent fraud, issue incentives or cards, and for marketing purposes.

How We May Use Information We Collect from You:

We may use the information we collect from you to provide the Services to you and to understand, improve, and enhance the Services. While these automated tools assist in decision-making processes, significant decisions affecting you (such as final loan approvals) are subject to human review and are not made solely on the basis of automated processing. The automated profiling considers factors such as financial data, interaction patterns, preferences expressed, and information provided during calls and form submissions. Our AI systems and their capabilities may evolve over time as we adopt new technologies and upgrade existing models to improve service quality and accuracy.

If you have received a commercial electronic message from us (regarding our products, services, news and events), it is because either you have previously provided your express consent, we have your implied consent under law, or because the type of message sent is exempt under the Information Technology Act and applicable telecom regulations. You have the option not to receive this commercial electronic message. We provide an opt-out function within all electronic marketing communications, or we will cease to communicate with you for this purpose if you email us at hello@vqualify.com and tell us not to communicate this information to you. While you maintain an account with us, we may contact you to notify you about changes to the Services, and other important Service-related notices, including but not limited to security and fraud notices, Service suspensions, and outages.  By providing your mobile number and contact information, you expressly consent to receive communications from us via: (a) SMS and text messages; (b) telephone calls, including pre-recorded or auto-dialled calls; (c) emails; (d) WhatsApp or other messaging platforms; and (e) push notifications through our mobile application, if any. How We May Disclose Information We Collect from You

The Platform will only share your information with Third Parties in accordance with your instructions or as necessary to provide you with a specific service (for example, our third-party payment processors, and our email service provider for the “Email Me New Leads” integration) or otherwise in accordance with applicable privacy legislation. As a general rule, unless permitted in this Privacy Notice, we do not and will not sell, rent, share, or disclose your Personal Data without first receiving your permission. When we disclose your Personal Data to third-party service providers, we take reasonable measures to ensure that the rules set forth in this Privacy Notice are complied with. The categories of Third Party service providers we engage include: (a) Payment processors and financial transaction facilitators; (b) Cloud infrastructure and hosting providers; (c) Artificial intelligence and machine learning service providers (including Google Gemini API and other AI platforms); (d) Customer relationship management (CRM) systems; (e) Email service providers (for the “Email Me New Leads” integration and other communications); (f) SMS and telecom gateway providers; (g) Analytics and business intelligence tools; (h) Fraud detection and prevention services; (i) API data providers; and (j) Security and compliance monitoring tools. Data Retention:

We will retain the User’s Personal Data as long as it is required to be retained for the provision of the Platform. We may also retain and use Users’ Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Change of Ownership or Business Transition:

In the event of a change of ownership, sale, merger, liquidation, reorganization or acquisition of the corporation, in whole or in part, Personal Data (including Lead Data) may be transferred as part of the transaction, as long as the party acquiring such Personal Data agrees to be bound by the terms of this Privacy Policy.

We will strive to prevent unauthorized access to your Personal Data, however, no data transmission over the Internet, by wireless device or over the air is guaranteed to be 100% secure. We will continue to enhance security procedures as new technologies and procedures become available.

We strongly recommend that you choose a strong, unguessable password, and that you do not disclose your password to anyone. If you forget your password, we will ask you for your email address and send you an email with instructions for resetting your password.

Children’s Privacy:

The Platform are not directed to children under the age of 18 years, and we do not knowingly collect Personal Data from children under the age of 18 years without obtaining parental consent. If you are under 18 years of age, then please do not use or access the Platform at any time or in any manner. If we learn that Personal Data has been collected on the Platform from persons under 18 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. Governing Laws and Disputes:

This Privacy Notice shall be construed and governed by the laws of India, including the Digital Personal Data Protection Act, 2023 and the rules made thereunder. Any disputes arising from this Privacy Notice or the processing of your Personal Data shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra. However, you retain the right to file a complaint with the Data Protection Board of India if you believe your rights under the DPDP Act have been violated.
